California law provides significant protections to consumers who hire licensed contractors. In general, a person who performs work that requires a contractor license but does not hold a valid California contractor license may be prohibited from suing to collect payment for that work.

Under California Business and Professions Code Section 7031, an unlicensed contractor may be barred from recovering compensation for construction services that legally required a contractor license. In some cases, consumers may even have the right to recover money already paid to an unlicensed contractor.

This means that hiring an unlicensed operator creates risks for both parties. The contractor may have no legal right to collect payment, while the homeowner may be exposed to potential liability, uninsured losses, defective workmanship, permit issues, and code violations.
